Crypto & Digital Assets — Probate & Practical Administration
A client has died. You know — or suspect — that cryptocurrency or other digital assets may form part of the estate.
What do you actually do next?
This live 3.5-hour workshop takes the principles from estate planning and applies them to the practical realities of estate administration.
Rather than focusing on what cryptocurrency is, Module 2 looks at the questions that arise once someone has died:
What should be preserved? What has actually been established? Who has authority to act? How do we deal with providers? How should the asset be valued? And what needs to happen before anything is sold, transferred or distributed?
The workshop is built around a practical four-stage framework:
PRESERVE → ESTABLISH → DECIDE → EVIDENCE
The aim isn’t to turn probate practitioners into crypto technicians. It’s to give you a structured process for dealing with cryptoassets safely, proportionately and with a clear evidence trail.
During the workshop, we'll cover
- What to do when cryptocurrency is reported, suspected or discovered in an estate
- Why the first decision shouldn’t simply be “how do we get in?”
- Preserving devices, documents and evidence without confusing preservation with authority to access
- The difference between ownership, access, control and legal authority
- How to work from clues towards evidence without treating assumptions as established facts
- Provider-held assets versus self-custody and why the administration route differs
- How to approach provider enquiries and record what has — and hasn’t — been confirmed
- The difference between a request being sent, authority being accepted, a holding being confirmed and an asset actually being released
- Establishing and evidencing a date-of-death valuation
- Why inaccessible or difficult assets don’t automatically have a nil value
- Recognising tax questions without trying to turn the probate file into a tax calculation
- Estate decisions involving sale, retention or distribution of cryptoassets
- Beneficiary preference versus entitlement and practical readiness to receive an asset
- When legal, tax, technical or valuation input may be required
- How to deal with unusual arrangements, conflicting evidence and suspicious recovery approaches
- Recording decisions, authority, outcomes and outstanding actions so the file tells the administration story
The focus is practical
This is not a technical wallet-recovery course. You won't be taught to test passwords, recover seed phrases, sign transactions or move cryptocurrency.
Instead, the focus is on helping you recognise what needs to be established before those sorts of actions are even considered, and making sure the right person deals with the right question.
Throughout the workshop, we’ll use practical estate scenarios to apply the process rather than simply discussing theory.
Who this workshop is for
This workshop is designed for will-writers, probate practitioners, estate administrators and private client professionals who may encounter cryptocurrency and digital assets during estate administration.
It is particularly relevant if you:

You should already understand concepts such as exchanges, wallets, private keys, seed/recovery phrases, self-custody and the distinction between access and legal authority.
